This website is operated by BANANOW FAMILY. Throughout these Terms and Conditions of Use, the terms “BANANOW”, “BANANOW Land”, “BANANOW.Land”, “we”, “us”, and “our” refer to BANANOW FAMILY and the BANANOW Land ecosystem.

BANANOW Land offers this website, its pages, content, links, Crops, community channels, Web3/NFT-related experiences, AI-related features, forms, tools, and future services to you, the user, conditioned upon your acceptance of these Terms, our Privacy Policy, and any other applicable notices, rules, or policies.

By accessing or using BANANOW Land, you agree to be bound by these Terms. If you do not agree to these Terms, please do not access or use BANANOW Land.

Any new feature, tool, page, Crop, program, community channel, NFT-related experience, AI-related feature, or other service added to BANANOW Land will also be subject to these Terms unless separate or additional terms are provided.

You can review the most current version of these Terms at any time on this page. We may update, change, or replace any part of these Terms by posting updates on our website. Your continued use of or access to BANANOW Land after any changes are posted constitutes acceptance of those changes.

1. Scope of These Terms

These Terms apply generally to BANANOW Land and its related services, including but not limited to:

  1. the BANANOW Land website;
  2. official BANANOW Land pages and links;
  3. The Green Print and related documentation;
  4. Na Now News and content-related pages;
  5. Skool Now and future program-related pages;
  6. BANANOW NFT / Heads-related pages and Web3 experiences;
  7. Claps and future AI-related features;
  8. community, social, and communication channels;
  9. forms, inquiries, collaboration requests, and support requests;
  10. future Crops, tools, campaigns, or services connected to BANANOW Land.

BANANOW Land may grow through different Crops, programs, pages, tools, campaigns, NFT-related experiences, AI features, media channels, community spaces, and real-world activities. Specific Crops or activities may have additional terms, rules, notices, program details, or disclaimers. Users should read the specific information provided for each Crop or activity before participating.

If there is any conflict between these general Terms and crop-specific terms, campaign rules, program terms, marketplace terms, official announcements, or third-party terms, the more specific or more recent official terms will apply for that specific activity.

Where interpretation is required, BANANOW Land may interpret and apply its terms in the way that best protects the Land, the Crops, the FAMILY, and BANANOW’s operational continuity, to the fullest extent permitted by applicable law.

Nothing in these Terms limits any non-waivable rights granted by applicable law.

2. Online Terms

By using BANANOW Land, you represent that you are at least the age of majority in your place of residence, or that you are using BANANOW Land with appropriate consent and supervision from a parent, guardian, or responsible adult where required.

You may not use BANANOW Land for any illegal, unauthorized, harmful, abusive, deceptive, or infringing purpose. You must not violate any laws in your jurisdiction, including intellectual property laws, privacy laws, consumer protection laws, financial regulations, child-safety laws, cybersecurity laws, or blockchain-related regulations where applicable.

The headings used in these Terms are included for convenience only and will not limit or otherwise affect these Terms.

3. General Conditions

You must not transmit any worm, virus, malicious code, exploit, spam, phishing attempt, scam, scraping tool, bot abuse, or any code or behavior of a destructive or harmful nature.

You agree not to reproduce, duplicate, copy, sell, resell, exploit, scrape, or misuse any portion of BANANOW Land, its content, its Crops, its visual assets, its writing, its code, its systems, its community spaces, or its official links without express written permission from BANANOW.

A breach or violation of these Terms may result in termination, restriction, blocking, removal, refusal of service, or other protective action.

4. Accuracy, Completeness, and Timeliness of Information

The material on BANANOW Land is provided for general information, storytelling, education, community communication, and project direction.

We do not guarantee that information made available on BANANOW Land is always accurate, complete, current, or suitable for your specific situation. Any reliance on the material on BANANOW Land is at your own risk.

We may modify, update, archive, correct, remove, or discontinue any content, page, tool, feature, Crop, program, service, or link at any time without prior notice.

BANANOW is a growing Land. Some seeds may grow. Some Crops may rest. Some links may change. Some features may appear, disappear, pause, or return when the season is right.

BANANOW Land may provide official links, redirect pages, social links, NFT-related links, documentation links, marketplace links, explorer links, community links, and historical links.

Always verify official URLs before connecting wallets, signing transactions, sending information, joining communities, or interacting with NFT-related pages.

Historical, legacy, archived, or deprecated links are part of BANANOW’s roots, memory, and soil. They should not automatically be treated as current active programs, current official campaigns, current NFT instructions, or current official offers unless clearly stated by BANANOW through current official channels.

The banana may be playful. Your wallet should stay awake.

6. Third-Party Links and Platforms

Certain content, products, services, pages, and tools available through BANANOW Land may include or link to third-party websites, platforms, wallets, marketplaces, blockchain explorers, social media platforms, payment providers, AI providers, hosting providers, documentation tools, or community services.

Third-party links may direct you away from BANANOW Land. We are not responsible for examining, evaluating, controlling, or guaranteeing third-party content, policies, terms, privacy practices, availability, accuracy, safety, pricing, listings, account actions, or technical behavior.

When you use a third-party platform, you may be subject to that platform’s own terms, privacy policy, community rules, fees, technical risks, and account decisions.

Please review third-party policies carefully before interacting with them.

Complaints, claims, concerns, or questions regarding third-party products, services, platforms, accounts, wallets, marketplaces, explorers, or transactions should be directed to the relevant third party.

7. Forms, Inquiries, and Communication

BANANOW Land may provide forms, contact flows, inquiry pages, email contact, or other communication methods for:

  1. general contact;
  2. program interest;
  3. Skool Now or future program registration or inquiry;
  4. partner inquiry;
  5. sponsor or investor inquiry;
  6. community participation;
  7. support or collaboration requests;
  8. future Crop-specific activities.

Submitting a form, message, or inquiry does not automatically create acceptance, partnership, sponsorship, investment relationship, employment, membership, program registration, service contract, or any binding agreement.

Any such relationship must be confirmed by BANANOW in writing or through the relevant official process.

You are responsible for ensuring that the information you submit is accurate, lawful, and does not violate the rights of any third party.

8. Products, Services, Crops, and Programs

Certain products, services, Crops, programs, pages, or activities may be available exclusively online, through third-party platforms, through community channels, or through real-world activities.

We may modify, pause, discontinue, rename, archive, replace, or relaunch any Crop, program, product, service, or feature at any time.

Specific Crops, programs, campaigns, marketplace features, AI features, or real-world activities may have their own additional rules, requirements, pricing, schedules, eligibility, safety rules, refund rules, cancellation rules, waivers, consent requirements, or participation terms.

You should read and understand the specific information for each Crop, program, or activity before participating.

9. Skool Now and Program-Related Activities

Skool Now and future program-related activities may include education, workshops, hobbies, sports, community learning, real-world events, online sessions, or other program formats.

Program-specific terms may apply.

Unless clearly confirmed by BANANOW through an official process:

  1. submitting a registration or inquiry does not mean acceptance into a program;
  2. program schedules may change;
  3. program locations may change;
  4. program pricing may change;
  5. refund and cancellation rules may differ by program;
  6. safety rules and participation rules may apply;
  7. guardian or parent consent may be required for minors;
  8. BANANOW may reject, cancel, postpone, or limit participation where necessary for safety, capacity, operational, or community reasons.

Participation in physical, sports, hobby, or real-world activities may involve risks. Users, participants, parents, guardians, and partners are responsible for reading the specific program details and making appropriate decisions.

10. Na Now News and Content

Na Now News and other BANANOW Land content may include stories, updates, articles, announcements, opinions, educational material, community memory, public notes, and other content.

Content on BANANOW Land is for general information, storytelling, education, and community communication. It is not professional legal, financial, medical, psychological, investment, or emergency advice.

BANANOW may edit, update, correct, remove, archive, reject, or refuse to publish content at its discretion.

User, author, community, partner, or contributor submissions may be reviewed before publication. BANANOW may refuse or remove content that violates these Terms, harms the Land, harms the FAMILY, infringes rights, spreads scams, promotes hate, creates legal risk, or damages operational continuity.

11. Claps and AI-Related Features

Claps and any AI-related feature that may be offered by BANANOW Land are provided for conversation, reflection, learning, support, and general informational purposes only.

AI-generated output may be incomplete, inaccurate, outdated, inappropriate, biased, or unsuitable for your specific situation.

Claps and AI-related features are not:

  1. medical advice;
  2. psychological advice;
  3. legal advice;
  4. financial advice;
  5. emergency support;
  6. a crisis service;
  7. a substitute for professional help;
  8. a substitute for parent, caregiver, teacher, or human judgment.

Users should not submit unnecessary sensitive personal data, especially data about children, health, family conflict, legal issues, identity documents, precise addresses, financial details, or emergencies.

BANANOW may limit, suspend, change, monitor, improve, or discontinue AI-related features at any time for safety, quality, operational, legal, or community reasons.

If you are facing an emergency, crisis, abuse, violence, self-harm risk, medical issue, legal emergency, or immediate safety concern, do not rely on BANANOW Land or Claps. Contact the appropriate professional, emergency service, trusted person, or local authority.

12. Web3, NFTs, Crypto Items, and Wallets

BANANOW Land may include Web3, NFT, blockchain, wallet, marketplace, minting, explorer, collection, and other crypto-related links or experiences.

You accept and acknowledge that Web3, NFTs, crypto items, wallets, blockchain networks, marketplace listings, and smart contracts involve significant risks.

These risks may include:

  1. price volatility;
  2. total loss of value;
  3. lack of demand;
  4. lack of marketplace liquidity;
  5. irreversible transactions;
  6. gas fees and transaction fees;
  7. failed transactions;
  8. wallet compromise;
  9. phishing and scams;
  10. fake links or impersonation;
  11. smart contract bugs;
  12. metadata decay;
  13. marketplace errors;
  14. regulatory uncertainty;
  15. third-party platform changes;
  16. public and permanent blockchain records.

BANANOW does not guarantee:

  1. profit;
  2. revenue;
  3. revenue share;
  4. financial return;
  5. marketplace liquidity;
  6. future access;
  7. future utility;
  8. future rewards;
  9. future benefits;
  10. token value;
  11. floor price;
  12. rarity value;
  13. continued support by any third-party platform.

BANANOW NFT may be understood as a collectible, a community signal, an on-chain memory, a Web3 identity marker, and one of the ways people can carry the BANANOW symbol in the 0101 Universe. It is not a financial promise.

Do not buy, mint, sell, list, hold, or interact with any NFT or crypto item with an expectation of profit or guaranteed benefit.

You are solely responsible for:

  1. your wallet;
  2. your private key;
  3. your seed phrase or recovery phrase;
  4. your device security;
  5. your transaction decisions;
  6. your tax obligations;
  7. your compliance with applicable laws;
  8. verifying official links before interacting.

BANANOW will never ask for your private key or recovery phrase.

13. NFT Artwork and Intellectual Property License

Unless a specific NFT collection states otherwise in its own official terms, purchasing, receiving, or holding a BANANOW-related NFT does not transfer the underlying copyright, trademark, brand rights, source files, creative process, component images, technology, or other intellectual property rights to you.

Where applicable, NFT ownership may provide a limited, personal, non-exclusive, non-transferable or ownership-dependent license to display the associated artwork, subject to the specific terms of that NFT collection and marketplace.

Unless expressly allowed by specific collection terms, you may not:

  1. claim ownership of BANANOW intellectual property;
  2. register or attempt to register BANANOW marks, artwork, names, logos, or characters;
  3. use BANANOW artwork to promote hatred, violence, harassment, discrimination, scams, illegal activity, or inappropriate behavior;
  4. imply endorsement, partnership, sponsorship, or official status without written permission;
  5. modify, commercialize, redistribute, or exploit BANANOW assets beyond what is expressly allowed.

If an NFT is transferred, sold, gifted, burned, or otherwise disposed of, any ownership-dependent license connected to that NFT may end automatically unless the specific collection terms state otherwise.

14. Historical, Legacy, or Deprecated NFT Contracts

BANANOW may have historical NFT contracts, legacy collections, earlier experiments, archived pages, deprecated contracts, or older marketplace links.

These may remain part of BANANOW’s memory, roots, and public history.

However, historical, legacy, or deprecated NFT links should not be treated as:

  1. current active programs;
  2. current official campaigns;
  3. current minting instructions;
  4. current marketplace instructions;
  5. current support commitments;
  6. guaranteed future utility;
  7. evidence of active roadmap promises.

When in doubt, return to the official BANANOW Land website and official current announcements.

15. Marketplace and Secondary Market

NFTs or crypto items may be listed, sold, purchased, transferred, or displayed through third-party marketplaces, blockchain explorers, or future BANANOW-related marketplace features.

BANANOW does not control third-party marketplace listings, seller behavior, buyer behavior, pricing, marketplace availability, marketplace fees, royalties enforcement, wallet provider behavior, metadata rendering, or third-party platform decisions.

If BANANOW later provides its own marketplace or marketplace interface, specific marketplace terms, fees, royalty rules, transaction rules, and risk notices may apply.

Royalty, fee, or marketplace logic can only be enforced within systems, contracts, or transactions where such logic technically applies. BANANOW does not guarantee that all third-party marketplaces will honor royalties, fees, or collection preferences.

16. Taxes

You are solely responsible for determining and paying any taxes, duties, fees, reporting obligations, or other costs that may apply to your use of BANANOW Land, your Web3/NFT transactions, your program participation, or your purchase or sale of any item.

BANANOW is not responsible for determining your tax obligations.

17. Community Spaces

BANANOW may operate or link to community spaces such as Discord, X, Instagram, YouTube, or other platforms.

BANANOW may reject, remove, block, ban, mute, restrict, or refuse any user or content that violates community rules, harms the Land, harms the FAMILY, creates legal risk, spreads scams, impersonates others, harasses people, or disrupts operations.

Ownership of any NFT, participation in any Crop, or previous interaction with BANANOW does not guarantee access to community spaces.

Community platforms may have their own terms, privacy policies, moderation rules, and account decisions.

18. Personal Information

Your submission of personal information through BANANOW Land is governed by our Privacy Policy.

Please review the Privacy Policy to understand how we may collect, use, process, store, disclose, and protect information.

19. Errors, Inaccuracies, and Omissions

There may be information on BANANOW Land or related services that contains typographical errors, inaccuracies, omissions, outdated details, broken links, incorrect references, or incomplete information.

We reserve the right to correct, update, change, archive, remove, or cancel any information at any time without prior notice.

No specified update or refresh date should be taken to indicate that all information has been modified or updated.

20. Prohibited Uses

You are prohibited from using BANANOW Land, its content, links, community spaces, tools, or services:

  1. for any unlawful purpose;
  2. to solicit others to perform or participate in unlawful acts;
  3. to violate any law, rule, regulation, or ordinance;
  4. to infringe or violate intellectual property rights;
  5. to harass, abuse, insult, harm, defame, slander, intimidate, or discriminate;
  6. to submit false or misleading information;
  7. to impersonate BANANOW, Farmers, users, partners, sponsors, or any third party;
  8. to upload or transmit malicious code;
  9. to collect or track personal information of others;
  10. to spam, phish, pharm, pretext, crawl, scrape, or exploit;
  11. to promote scams, fake links, fake mints, fake marketplaces, or wallet-draining activity;
  12. to interfere with or circumvent security features;
  13. to misuse AI-related features;
  14. to submit unnecessary sensitive child data or emergency data into general forms or AI features;
  15. to use BANANOW Land in a way that harms the Land, the Crops, the FAMILY, or operational continuity.

We reserve the right to terminate, restrict, block, or refuse access for violating prohibited uses.

21. Disclaimer of Warranties

BANANOW Land is provided “as is” and “as available”.

We do not guarantee, represent, or warrant that:

  1. the website will be uninterrupted, timely, secure, or error-free;
  2. all links will always work;
  3. all content will always be accurate, complete, or current;
  4. all services will remain available;
  5. all third-party platforms will remain available;
  6. all blockchain data will render correctly;
  7. all AI output will be accurate or suitable;
  8. all NFT metadata will remain accessible through third-party systems;
  9. any Crop, program, or service will continue forever.

You expressly agree that your use of BANANOW Land is at your sole risk.

22. Limitation of Liability

To the fullest extent permitted by applicable law, BANANOW, its Farmers, contributors, operators, partners, affiliates, officers, directors, employees, agents, contractors, service providers, licensors, and related parties shall not be liable for any direct, indirect, incidental, punitive, special, consequential, or similar damages arising from or related to:

  1. your use of or inability to use BANANOW Land;
  2. errors, omissions, or inaccuracies in content;
  3. website downtime or technical failure;
  4. third-party platforms;
  5. wallet compromise;
  6. blockchain transactions;
  7. NFT value loss;
  8. lack of NFT liquidity;
  9. AI output;
  10. program changes or cancellations;
  11. social media or community platform actions;
  12. unauthorized access;
  13. loss of data;
  14. lost profits, lost revenue, lost savings, or replacement costs;
  15. scams, impersonation, fake links, or third-party solicitations.

Where some jurisdictions do not allow certain exclusions or limitations of liability, our liability will be limited to the maximum extent permitted by applicable law.

23. Indemnification

You agree to indemnify, defend, and hold harmless BANANOW, its Farmers, contributors, operators, partners, affiliates, officers, directors, employees, agents, contractors, service providers, licensors, and related parties from any claim or demand, including reasonable legal fees, arising out of or related to:

  1. your breach of these Terms;
  2. your violation of any law;
  3. your violation of third-party rights;
  4. your misuse of BANANOW Land;
  5. your content or submission;
  6. your wallet activity;
  7. your interaction with third-party platforms;
  8. your participation in any Crop, program, community space, or Web3/NFT activity.

24. Severability

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms.

Such determination shall not affect the validity and enforceability of any remaining provisions.

25. Entire Agreement

These Terms, together with our Privacy Policy and any applicable crop-specific terms, program terms, marketplace terms, AI terms, official announcements, or specific notices, constitute the agreement between you and BANANOW regarding your use of BANANOW Land.

These Terms supersede prior versions of the Terms for the general use of BANANOW Land.

Failure by BANANOW to exercise or enforce any right or provision of these Terms does not constitute a waiver of such right or provision.

26. Governing Law and Disputes

These Terms and any separate agreements whereby BANANOW provides services shall be governed by and construed in accordance with the laws of the Republic of Indonesia, without prejudice to any mandatory consumer protection, privacy, or other non-waivable rights that may apply under applicable law.

The parties should first try to resolve any dispute through good-faith informal discussion and negotiation.

If a dispute cannot be resolved informally, it may be referred to and finally resolved by arbitration administered by BANI Arbitration Center under the applicable BANI rules, unless mandatory applicable law provides otherwise.

The seat of arbitration shall be Jakarta, Indonesia. The language of the arbitration shall be English, unless the parties agree otherwise.

Nothing in this section limits any non-waivable rights granted by applicable law.

27. Changes to These Terms

You can review the most current version of these Terms at any time on this page.

We reserve the right, at our discretion, to update, change, or replace any part of these Terms by posting updates on BANANOW Land.

It is your responsibility to check this page periodically for changes.

Your continued use of or access to BANANOW Land after any changes are posted constitutes acceptance of those changes.
